HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Civil Revision Petition No.3521 of 2015 ORDER :

This Civil Revision Petition is filed under Article 227 of Constitution of India by the Petitioner/Plaintiff impugning not taking up of I.A.No.149 of 2013 on the file of the Principal Junior Civil Judge, Rayachoti in O.SNo.24 of 2013.

2. Heard the learned counsel for the petitioner who is the plaintiff in O.SNo.24 of 2013 and petitioner in the temporary injunction petition in I.A.No.149 of 2013 maintained against the defendants-respondents 1 to 3 which impugned herein that the lower Court having posted the matter for orders, after hearing, to 13.08.2015 finally on 06.08.2015, again as orders not ready to 20.08.2015 on that day suo-motu reopened and on further hearing posted to 24.08.2015 and kept pending again by posted to 25.08.2015, hence the trial Court instead of disposing the matter, postponing and the interim order all through till 09.12.2014 is later not extended and thereby to direct the lower Court to dispose of the matter and extend interim order meantime.

In view of the above submission, before admission and before issuance of notice to respondents, the trial Court is directed to dispose of the matter as already heard as can be seen from the docket order referred supra, if any further hearing required, by fixing date 28.09.2015 and dispose of I.A.No.149 of 2013 impugned herein by pronouncement orders at least by 05.10.2015 meanwhile to consider the extension of interim order after hearing both sides. 4.The Civil Revision Petition is disposed of with no costs. Consequently, miscellaneous applications, if any, pending in this Petition shall stand closed.
