As there was no representation on behalf of the petitioner on 20.06.2017, the matter was directed to be listed today under the caption 'for dismissal'. Inspite of the matter being listed under the caption 'for dismissal', there is no representation on behalf of the petitioner today. 2.
The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent Nos.2 to 4 in not registering a case or taking any action on the complaint made by the petitioner dated 21.05.2017 before respondent No.4, as illegal and arbitrary. 3.
Learned Government Pleader, on instructions, submits that the wife of the petitioner is staying with her parents and her statements indicate existence of some disputes between the parties. Further, it is stated that the averments made in the writ affidavit are false. 4.
In view of the above submissions and in the absence of the petitioner, inspite of the matter being listed under the caption 'for dismissal', the relief sought for cannot be granted and the writ petition is dismissed. However, it is open to the petitioner to avail the remedy if any available under law. No costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
