HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16297 OF 2015 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for respondents 1 to 5, Sri G.Narender Reddy counsel for respondent No.6 and Sri B.Nalin Kumar, counsel for the respondent No.7.

2. Against the order of removal of the petitioner as Sarpanch of Cheburthy Gram Panchayat, Jagdevpur Mandal, Medak District, petitioner preferred appeal before the appellate authority under Section 249(1) of the Andhra Pradesh Panchayat Raj Act, 1994. Along with the appeal, petitioner has also filed petition to stay all the proceedings by which petitioner was removed. Alleging that so far appeal is not considered and disposed of, this writ petition is filed.

3. As per the instructions furnished to the learned Government Pleader, said appeal filed by the petitioner is pending consideration by the appellate authority.

4. Since the appeal is pending for consideration by the appellate authority, without expressing any opinion on merits, the writ petition is disposed of directing the appellate authority to consider and pass appropriate orders as warranted by law on the appeal filed by the petitioner against her removal as

Sarpanch as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. Petitioner shall be given personal hearing and petitioner is also entitled to submit all the relevant documents in support of her claim.

Miscellaneous petitions if any pending in the writ petition shall stand closed. No costs.
