This Writ Petition is filed for the following relief: "....to issue a writ or order or direction more particularly in the nature of writ of Mandamus to declare the action of the 3rd Respondent in rejecting to release the vehicle Ashok Leyland Tata Ace Vehicle Regd No TS05UC7899 A Class of vehicle DOST plus RLs GOOD CHASSISW LLB and FBCWRFA and PS FSD BSIV B Model 02/2018 C Chassis No MB1AA22E6JRG96183 D Engine No JA06EJEGL06368 2 Condition of the Vehicle Road Worthy is as illegal unconscionable without jurisdiction of law against the Principles of Natural Justice and clear Violation of Article 21 and 41 of the Constitution of India and also by the 3rd Respondent and consequently direct the 3rd Respondent to release the vehicle Ashok Lyland Tata Ace Vehicle Regd no TS05UC7899 A Class of vehicle DOST PLUS RLs Good CHASSISW LLB AND FBCWRFA AND PS FSD BSIV B MODEL 02/2018 CChassis No MB1AA22E6JRG96183 D Engine NO JA06EJEGL06368 2 condition of the vehicle road worthy."
Heard learned counsel for the petitioner.
As the vehicle of the petitioner was seized by respondent No.3 on the ground of violation of the excise laws, the petitioner is at liberty to submit an application before the jurisdictional Deputy Commissioner under Section 34 of the Telangana Excise Act seeking release of the subject vehicle. Thereupon, the said
CKR, J W.P.No.21208 of 2019 authority shall consider and pass appropriate orders on such application within a period of one week from the date of receipt thereof.
Subject to the above, this Writ Petition is disposed of. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
