Heard the learned counsel for the petitioner and the learned Government Pleader for Home for the State of Telangana. With their consent, the present writ petition is disposed of at the admission stage itself.

The Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of a writ of mandamus declaring the action of the 4th respondent in causing delay in registering the case on the petitioner's complaint dated 17.05.2017 as highly illegal, arbitrary and consequently, direct the 2nd respondent to conduct the departmental enquiry about the illegal activities of the 4th respondent.

At the time when the matter is taken up for hearing, learned Government Pleader for Home, on instructions, states that since the allegations in the complaint disclose commission of non-cognizable offences, police have presented the same before the Judicial Magistrate of First Class, Special Mobile Court, Nagar Kurnool, seeking permission of the Court for registering a crime and that the said proceedings are pending.

Therefore, it cannot be said that there was any delay or negligence on the part of the respondents in acting the report of the petitioner.

Accordingly, the Writ Petition is disposed of, directing the respondents - police to take steps on the report dated 17.05.2017 given by the petitioner, which is pending before the concerned Court, in accordance with law, at the earliest. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C.
