THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.163 of 2015 JUDGMENT:- The present Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. questioning the order dated 23.01.2015 passed in Crl.M.P.No.172 of 2015 on the file of I Additional Judicial Magistrate of First Class at Khammam wherein the application filed under Section 452 Cr.P.C. was returned as not maintainable. Challenging the same, the present revision is filed. The case of the petitioner is that he is the owner of Ford Fiesta Car bearing registration No.RJ 16CA 1385 which was involved in Crime No.477 of 2014 of Khammam I Town Police Station registered for the offences punishable under Sections 420 r/w 511 IPC and Sections 66C & 66D of I.T. Act, 2008. At the time when the matter is taken up for hearing, it is brought to the notice of the Court that on 08.01.2015 the matter was referred to Lok Adalat Bench at Khammam wherein the compromise arrived at between the parties was recorded and the learned Judge acquitted the accused.

In view of the above and as there is no dispute with regard to the ownership of the vehicle, the Criminal Revision Case is allowed and the vehicle i.e., Ford Fiesta Car bearing registration No.RJ 16CA 1385 seized in Crime No.477 of 2014 of Khammam I Town Police Station is ordered to be released in favour of the petitioner forthwith.

Consequently, miscellaneous petitions, if any, pending in the revision shall stand closed.
