This Criminal Petition is filed under Section 438 of Cr.P.C.

by petitioner/Accused No.5 seeking anticipatory bail in connection with Crime No.367 of 2023 dated 24.06.2023 on the file of Police Station, RGI Airport, Shamshabad, Cyberabad registered for the offences punishable under Sections 406, 420, 506, 354C, 120-B of Indian Penal Code (for short "IPC") and Section 5 of the Telangana Protection of Depositors of Financial Establishments Act-1999.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The allegation against accused Nos.1 to 4 is that they have committed acts punishable under Sections 406, 420, 506, 354-C, 120-B of IPC and Section 5 of the Telangana Protection of Depositors of Financial

Establishments Act-1999 for collecting huge amounts from depositors/general public running into crores of rupees.

The allegation against this petitioner is that he is close associate of accused Nos.1 to 4 and after the crime was committed, petitioner allegedly facilitated accused Nos.1 to 4 abscond.

Since, the main allegations are not levelled against this petitioner and the only allegation is that he facilitated accused Nos.1 to 4 to abscond, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioner/Accused No.5 is directed to surrender before the Station House Officer, RGI Airport, Shamshabad, Cyberabad on 23.08.2023. Upon such surrender, the said Station House Officer shall release petitioner/Accused No.5 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand

only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused Nos.5 shall appear before the concerned police every Monday and Wednesday for eight weeks at 10.00 a.m. and thereafter, as and when required for the purpose of investigation.

3) The petitioner/Accused No.5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with Investigating Officer in investigating the case. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
