THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5798 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who are arrayed as Accused Nos.2, 5, 7 to 11 in the event of their arrest in Crime No.154 of 2022 on the file of Station House Officer, Bibinagar Police Station, Rachakonda, registered for the offences punishable under Sections 324, 504 and 148 read with Section 149 of Indian Penal Code.

Heard learned counsel for petitioners/Accused and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case against the petitioners is that on 22.05.2022 in respect of land at Chandu Naik Thanda these petitioners and the accused in Crime No.153 of 2022 fought among themselves and members of both the groups received injuries. Pursuant to the same, a case filed by these petitioners registered as Crime No.153 of 2022 and case against these petitioners is Crime No.154 of 2022. The case and counter case arising out of the very same incident.

As seen from the medical certificate submitted by the learned Assistant Public Prosecutor there is one grievous injury and one simple injury caused by these petitioners. Further, for the reason of there being family disputes regarding property, the petitioners who are Accused Nos.2, 5, 7 to 11 can be granted the relief of anticipatory bail as there are no specific overt acts. 5.
Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2, 5, 7 to 11 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.2, 5, 7 to 11 are directed to surrender before the Station House Officer, Bibinagar Police Station, Rachakonda within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.2, 5, 7 to 11 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of six (06) weeks or till filing of charge sheet whoever is earlier.
iii) The petitioners/Accused Nos.2, 5, 7 to 11 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. 6.
As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
