The case of the petitioner is that his mother Mrs. Afzal Begum was the absolute owner and possessor of the property bearing Municipal No.16-6-363 (Old No.1070) admeasuring 305 Sq.yards, situated at Khidki Boodh Ali Shah, Noor Khan Bazar, Hyderabad, on the basis of the Registered Gift Deed executed by his father. The petitioner's mother, out of love and affection, gifted the said property to the petitioner vide Registered Gift Deed Document No.31 of 1992. It is his further case that his mother has never during her lifetime revoked the Gift Deed executed in favour of the petitioner, but the respondents, more particularly respondent No.4, has allowed a Deed of Revocation/Dissolution dated 28.08.1993 vide Document No.2210 of 1993 whereunder and whereby the Registered Gift Deed Document No.31 of 1992 pertaining to the petitioner was unilaterally cancelled.
Heard the learned counsel for the petitioner, and the learned A.G.P. for Revenue, State of Telangana.
Learned counsel for the petitioner submits that the subject matter of the present writ petition is covered by the orders passed by this Court in W.P.No.19872 of 2016, dated 16.09.2016.
This Court has dealt with similar issue in W.P.No.19872 of 2016 holding that there cannot be unilateral cancellation of documents. For the reasons stated in W.P.No.19872 of 2016 and in terms thereof, the present writ petition is also allowed. No costs. Miscellaneous petitions, if any pending, shall stand closed.
