THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7603 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.4 seeking anticipatory bail in the event of his arrest in connection with F.I.R.No.92 of 2023 on the file of Nalgonda Rural Police Station, Hyderabad, registered for the offences under Sections 448, 312, 344, 366, 376 (2) (n), 376 (3), 506 and 109 of IPC and Section 5 (i) (ii) r/w. Section 6 of Protection of Children from Sexual Offence Act, 2012. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Police is that A-1 married the victim girl. Thereafter, this petitioner allegedly permitted A-1 and the victim girl to stay in his house for four days. Since the victim girl was minor, on the basis of the complaint given by the father of the victim girl, a case was registered for the above said offences. 4.

Admittedly, the only allegation against this petitioner is that he had permitted the accused No.1 and the victim girl to stay in his house for four days. The said act of the petitioner does not amount to any of the grave offences mentioned in the compliant.

Accordingly, this petitioner can be granted relief of anticipatory bail, subject to the following conditions:-

1) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Nalgonda Rural Police Station on 21.08.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.4 on bail, on his executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to its satisfaction.

2) On such release, the petitioner/Accused No.4 shall appear before the concerned Police as and when required for the purpose of investigation.

3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
