THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42757 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition.
In response to second notice dated 06.08.2015 issued by the Special Collector/Land Acquisition Indra Sagar Project, Rajahmundry, East Godavari District, the 3rd respondent, the petitioner has filed objections through his counsel on 06.11.2015 making a claim for compensation with regard to land admeasuring Ac.1.80 cents in Survey No.7/5, which is stated to have been wrongly shown in the name of Mandava Bhushaiah as against the rightful claim to an extent of Ac.0.70 cents. The petitioner states that the land admeasuring Ac.0.70 cents belong to him and the land admeasuring Ac.1.80 cents belong to Mandava Bhushaiah and seeks compensation to an extent of Ac.0.70 cents of land.
The said objections were sent to the 3rd respondent under registered post with acknowledgment due on 12.11.2015 and no award has been passed so far. Apprehending that the 3rd respondent would pass award, the petitioner filed the present Writ Petition.
I do not see any reason in the apprehension of the petitioner as his objections sent through his counsel have already been acknowledged, as stated above, by the 3rd respondent. Since the objections of the petitioner are pending, the 3rd respondent shall therefore consider the same at the time of passing of the award in pursuance of the notice, referred to above.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
