THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13516 of 2005 ORDER:
This writ petition was filed assailing the proceedings dated 15.04.2005 and 05.05.2005 of the Andhra Pradesh State Road Transport Corporation (APSRTC). A consequential direction was sought to the APSRTC to post the petitioner at Maddilapalem Depot in Visakhapatnam District.
The proceedings dated 15.04.2005 was an office order whereby the petitioner and an other employee were transferred on administrative grounds. So far as the petitioner is concerned, he was transferred from Maddilapalem Depot to Narsipatnam Depot. By the subsequent proceedings dated 05.05.2005, the Regional Manager, APSRTC, Visakhapatnam, rejected the petitioner's representation whereby he sought retention at Maddilapalem Depot, Visakhapatnam District.
By order dated 27.06.2005, this Court granted interim suspension of all further proceedings pursuant to the impugned proceedings dated 15.04.2005 and 05.05.2005. However, upon the vacate stay petition filed by the APSRTC in W.V.M.P.No.2426 of 2005, this Court passed orders on 08.09.2006 taking note of the fact that the transfer was effected only on administrative grounds and accordingly vacated the earlier order of interim suspension. In the light of the afore-stated facts, the transfer order, which was impugned in this writ petition, had to be acted upon and the challenge thereto does not survive for consideration on merits at this late stage.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
