HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.4352 of 2007 ORDER :

Pursuant to the Notification dated 16.02.2006 issued by the respondents, the petitioner has applied for the post of Anganwadi Worker in Jellipalli Village, Kodur Mandal, Anantapur District.

The petitioner belongs to BC-B Community and she passed S.S.C. Examination. She possessed the requisite qualifications for appointment to the post of Anganwadi Worker. She was called for the interview to be held on 08.11.2006 and appeared for the same. When no action was taken pursuant to the said interview, the petitioner filed the present writ petition.

While admitting the writ petition, this Court, by order dated 02.03.2007, directed the respondents to announce the results and consider appointment of the petitioner, if she is selected.

A counter affidavit is filed on behalf of the respondents stating that three candidates applied for the post of Anganwadi Worker and the petitioner is one among them. All the three applicants attended the interview on 08.11.2006. The petitioner did not answer any question at the time of interview and she failed, while the other two candidates were found to be under-aged. In those circumstances, no candidate was found to be eligible.

Thus, it is clear that all the three candidates are found to be unfit for selection and in those circumstances, the petitioner was not selected for the post of Anganwadi Worker. Since, the petitioner is not qualified at the time of interview, no Writ of Mandamus can be issued in her favour. 5.

Accordingly, the writ petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
