JUDGMENT:
This appeal arises out of the judgment and decree, dated 25.03.2005 in O.S.No.18 of 1999 on the file of learned VIII Additional District and Sessions Judge, Fast Track Court, Visakhapatnam. Mr.Ch.V.Suryanarayana Murthy, learned counsel for the appellant, addressed a letter, dated 31.03.2015, to the Registrar (Judicial) of this Court, wherein it is, inter alia, mentioned that the parties have settled the dispute out of Court and a request for posting of the case under the caption 'For Withdrawal' was made. At the hearing, Mr.Ch.V.Suryanarayana Murthy, learned counsel for the appellant, has reiterated the contents of the aforesaid letter and requested for permission to withdraw the appeal. In view of the above facts, the request of the learned counsel for the appellant is accepted.
The Appeal Suit is accordingly dismissed as withdrawn. As a sequel to dismissal of the Appeal Suit, interim order, dated 02.08.2005, in A.S.M.P.No.1462 of is vacated and A.S.M.P.No.1462 of 2005 filed by the appellant for interim relief shall stand dismissed as infructuous.
