Heard learned counsel for petitioner, the Government Pleader for Excise appearing for respondents 1 & 2, and the Government Pleader for Revenue for 3rd respondent. It is stated by counsel on both sides that the issue raised in the Writ Petition is covered by the order dated 14.02.2017 in W.P.No.5038 of 2017.

Therefore, for reasons alike, this Writ Petition is also allowed and the impugned notice, dated 28.04.2018, in M.C.No.B/241/2018 is set aside. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
