It is the case of the petitioner that his representation dated 26.07.2019 has not been considered by the respondent authorities for payment of compensation though his land is being affected in laying pipeline for Talelamma Lift Irrigation Scheme on the foreshore of Singuru Project, which is also called Shri Renuka Yellamma Lift Irrigation Scheme. Heard the learned counsel for the petitioner. When the matter came up on 26.09.2019, learned Government Pleader sought time for getting instructions, and even today, he seeks further time.

Inasmuch as there is no dispute that petitioner's land is being utilized for the purpose of laying pipeline under the said Lift Irrigation scheme, and as Article 300-A of the Constitution of India mandates that no citizen shall be deprived of his property without paying compensation as per law, the respondent No.4-District Collector is directed to determine the compensation amount payable to the petitioner, in accordance with law, and pay the same within a period of three months from the date of receipt of a copy of this order. It is also made clear that the petitioner shall be entitled to all benefits as available in law.

Accordingly, the writ petition is allowed. No costs. Miscellaneous petitions, if any pending, shall stand closed. ____________________________ CHALLA KODANDA RAM, J 24th October, 2019 KSM
