This Writ Petition is filed by the petitioner invoking Article 226 of the Constitution of India seeking the following relief: " ... to issue an appropriate writ, order or direction more particularly one in the nature of writ of MANDAMUS Declaring the high handed action of the respondents 4 and 5 in trying to dispossessing the petitioner from the agricultural land in Sy. No 493/2P admeasuring Ac 5-00 cents at the behest of 6th respondent situated at Bommireddy Pally Village, Kanigiri Mandal, Prakasam District without following the due process of Law, interfereing with the Possession as being Illegal, Arbitrary, Capricious Malafide, Violative of principles of Natural Justice, Violative of Article, 14, 21 and 300 A of Constitution of India and pass such other order or orders as this Honourable Court may deem think fit and proper in the circumstances of the case"

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondent Nos 1 to 5. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put R-6 on notice since this Court is not venturing the adjudicate the case on merits.

The main grievance of the petitioner is that the official respondents, at the instance of R.6, are trying to interfere with his peaceful possession and enjoyment over the subject land. Learned AGP would submit that any action would be only in accordance with law.

Recording the statement of the learned AGP, this Writ Petition is disposed of directing respondents 1 to 5 not to dispossess the petitioner from the agricultural land in survey No.493/2P admeasuring Acs.5-00 gts. situated at Bommireddy Pally Village, Kanigiri Mandal, Prakasam District, if the petitioner is in possession, without following due process of law. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
