THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38800 of 2015 ORDER:
The grievance of the petitioner in this case is as under: "It is therefore prayed that this Hob'ble Court may be pleased to issue a Writ, order or direction especially one in the nature of Writ of Mandamus declaring that a) the ejectment decree and orders passed by the 3rd respondent in LRT Case No.2/2015/YLD, dated 29.07.2015 is illegal and arbitrary.
b) Declare that the 4th respondent has no power to take the possession of the land to an extent of Ac.0.33 gts. In Sy.No.463 of Sudimalla Villae, Yellandu Mandal, Khammam District belong to the petitioner.
c) And pass such order or orders which may deem fit and proper in the circumstances of the case"
By order dated 30.11.2015, this Court took note of the fact that the petitioner's appeal was pending consideration but no stay order had been passed therein and accordingly directed maintenance of status quo pending further orders.
Sri M.Srinivasa Rao, learned counsel for the petitioner, now states that the petitioner's appeal has been entertained by the Project Officer, Integrated Tribal Development Agency, Bhadrachalam, Khammam District, the 2nd respondent, and numbered as Case No.60 of 2015. Learned counsel would further state that the I.A. is posted for hearing on 16.03.2015.
In that view of the matter, the writ petition is disposed of directing the 2nd respondent to consider the petitioner's stay application in the pending appeal on merits and pass appropriate reasoned orders thereon in accordance with law. Until completion of this exercise, status quo as directed by this Court shall be maintained. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
