Penugonda Laxmi v. The Superintendent Of Police,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33918 OF 2012 DATED: 01.07.2015 Between:
Penugonda Laxmi .. Petitioner And The Superintendent of Police, Eluru, West Godavari District, and others.
.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33918 of 2012 ORDER:
The grievance of the petitioner in this case was that the police authorities were not taking appropriate action in connection with Crime No.104 of 2012 which was registered on the file of Penumanthra Police Station, West Godavari District, upon her complaint.
The Sub-Inspector of Police, Penumanthra Police Station, West Godavari District, filed a counter-affidavit stating that upon the petitioner's complaint, Crime No.104 of 2012 had been registered under Sections 354, 427, 448 and 506 I.P.C. read with Section 34 I.P.C. on the file of his police station.
However, upon due investigation, the police authorities came to the conclusion that there was no case made out for criminal prosecution and accordingly filed a final report before the court concerned on 14.11.2012 vide S.R.No.11328 stating to the effect that the case was false. In the light of the afore-stated development, it is for the petitioner to avail appropriate remedies in accordance with law, if she is
aggrieved by the conclusion arrived at by the police authorities. Reserving liberty to the petitioner to do so, the writ petition is closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
