No.480 of 2014 passed by the Hon'ble Central Administrative Tribunal, Hyderabad Bench, Hyderabad and set aside the same as contrary to law, illegal, arbitrary, unjust.

WPMP.NO: 37118 of 2015 Petition under Section 151 of C.P.C. praying that in the circumstances stated in the affidavit filed in the W.P., the High Court may be pleased to suspend the operation of the order dated 13-3-2015 in O.A. No.480 of 2014, pending disposal of WP No.28636 of 2015 on the file of the High Court. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and order of the High Court dated 19-01-2016 made herein and upon hearing the arguments of Sri B. Narayana Reddy, Assistant Solicitor General for the Petitioners and Sri K. Sudhaker Reddy, Advocate for Respondent No.1, the Court made the following ORDER:

The short issue that requires to be examined in this writ petition is whether the Tribunal is justified in directing the writ petitioners to treat

the diploma in Rubber Technology of 2 1⁄2 years duration held by the 1st respondent, equivalent to three years diploma Course in Rubber Technology which is the essential qualification as per the advisement, on the ground that no University in India is offering s the said course of three years duration and only the institution where the 1sr writ respondent obtained the qualification, is going the said course, and in further directing the 1st writ petitioner to appoint the 1st respondent to the post of Senior Technical Assistant- B in Rubber Technology? Post the writ petition for orders next week and till then, the interim suspension granted by this Court on 19.01.2016 shall continue.
