HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.21551 of 2016 ORDER:

1 This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the seizure of stocks of 9292 Liters of Edible Oils and 73.75 Quintals of Pulses worth Rs.14,10,543/- under the cover of 6-A report dated 19.9.2015 is illegal and arbitrary. 2 Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (Andhra Pradesh). 3 At the time of arguments, the learned counsel for the petitioner submitted that the 2nd respondent may be directed to release the stocks on furnishing bank guarantee by the petitioner. The learned Assistant Government Pleader submitted that on 16.07.2016 the District Collector passed an order for sale of the seized stocks.

4 Having regard to the submissions made by the learned counsel for both parties, the second respondent is hereby directed to release the seized stock of edible oil and pulses seized on 18.09.2015 from the petitioner on furnishing bank guarantee by the petitioner for an amount of Rs.14,10,543/-, if the seized stock has not already been sold. 4 With the above direction, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
