Learned counsel for the appellant represented that the sole appellant died on 23.05.21996 and no legal representatives were brought on record till today and, therefore, the appeal has been dismissed as abated by operation of law.

Accordingly, the Appeal Suit is dismissed as abated. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Appeal Suit shall stand closed.
