HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.21270 of 2019 ORDER:
This writ petition is filed to declare the action of the respondents in seizing the cattle and detaining them at Palavancha Gowshala on 18.09.2019 vide FIR.No.288 of 2019, dt.18.09.2019, as arbitrary and illegal.
When the matter is listed today, there is no representation on behalf of the petitioner.
The learned Assistant Government Pleader for Home, on written instructions dt.26.09.2019, would submit that on 18.09.2019, the 3rd respondent - Inspector of Police, Bhadrachalam Police Station, along with staff while conducting vehicle checking at Forest Check Post, Bhadrachalam, found two lorries illegally transporting 69 cattle. On that a case in Crime No.288 of 2019 for the offences punishable under Section 11 r/w. Section 38 of Prevention of Cruelty to Animal Act, and Sections 5, 6 and 7 r/w. Section 11 of Telangana State Prohibition of Cow Slaughter and Animals Prevention Act, and Rules 49 to 56 of Transport of Animals Rules, was registered on 18.09.2019 in Bhadrachalam Town Police Station. When the said vehicles were detained by respondent No.3, the petitioner claimed that the cattle are being carried at the request of the Zoo authorities in Hyderabad for supplying meat to the animals in Zoo, however, no such communication addressed by the Zoo authorities has been produced either before respondent No.3 or before this Court. TVK,J W.P.No.21270 of 2019 the cattle was being transported illegally in contravention of the provisions of various enactments stated supra, respondent No.3 has shifted the cattle to one Annapurna Go Samrakshana Samithi, Palavancha, for safe custody and investigation was taken up in FIR.No.288 of 2019 and after completion of investigation, charge sheet was filed on 21.09.2019 before the learned Judicial Magistrate of First Class, Bhadrachalam, and C.C. number is awaited.
Recording the said submission of the learned Assistant Government Pleader for Home, this writ petition is closed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
