HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.8229 of 2017 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of charge sheet in C.C.No.575 of 2015 on the file of the XXIV Metropolitan Magistrate, Kukatpally at Miyapur District. Originally a private complaint came to be filed, which was referred by the police under Section 161 of Cr.P.C and after investigation, the charge sheet came to be filed against the petitioner and others. The trial Court took cognizance of the case for the offences punishable under Sections 406, 420, 497 and 506 read with Section 34 of IPC. Though the charge sheet was filed in the year 2015, the present application is filed in the year 2017. No reasons are forthcoming as to why this criminal petition is filed nearly after two years from the date of taking cognizance of the matter.
However, the learned counsel for the petitioner seeks permission to file discharge application before the trial Court and seeks a direction to the trial Court not to insist on the presence of the petitioner on every date of adjournment, as there is no dispute with regard to her identity.
Having regard to the circumstances stated above; taking into consideration the plea made and since there is no dispute with regard to the identity of the petitioner, her presence in
C.C.No.575 of 2015 on the file of the XXIV Metropolitan Magistrate, Kukatpally at Miyapur District is dispensed with, except on the dates when her presence is specifically required by the trial Court. Further, the petitioner is at liberty to file an application seeking discharge before the trial Court. Accordingly, the criminal petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
