This writ petition is filed seeking mandamus to declare the inaction of the second and third respondent in not registering the crime on the complaint dated 14/5/2018 filed by the petitioner, as illegal, arbitrary and violative of Article 14 and 21 of the Constitution of India and violation of section 154 of Cr.P.C. and against the principles laid down in LALITHA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH reported in [2014] 2 SCC-1 and to declare the inaction of the respondents in not providing protection to the petitioner's life and personal liberty, as illegal, violation of Article 21 of the Constitution of India and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
3. The learned Assistant Government Pleader for Home appearing for the respondents produced copy of FIR.No.522 of 2018 registered on 08/6/2018 for the offences punishable under section 447, 427, 506 read with section 34 of IPC basing on the complaint lodged by the petitioner.
4. The learned counsel for the petitioner represented that the petitioner also made a representation to the Commissioner of Police, Cyberabad, on 14/5/2018 for grant of protection and the same may be considered and pass appropriate orders in accordance with law.
5. In view of the same, the second respondent is directed to dispose of the representation dated 14/5/2018 submitted by the petitioner for grant of protection to petitioner and pass appropriate orders in accordance with law.
6. With the above direction, the writ petition is disposed of at the admission stage.
