The petitioner challenges the order dated 14/12/2007 in EP.No. 872 of 2003-2004 on the file of first respondent. Admittedly against the impugned order dated 14/12/2007 remedy of appeal under section 76 of the Act is available. Learned counsel requests the court to permit him to avail the statutory remedy of appeal.

2. The writ petition is dismissed as withdrawn by granting liberty as prayed for. No costs.
