THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7365 of 2009 ORDER:

This Writ Petition was filed challenging the action of the first respondent in returning the application of the petitioners submitted for establishment of Technical Institution for imparting training in MBA course at Thattuvaripalli Village of Chittoor District, and for a consequential direction to reconsider and grant recognition to the second petitioner's college for the academic session 2009 - 2010 onwards.

This Court, while admitting the Writ Petition on 08.04.2009, granted interim direction to the first respondent to receive and reconsider the petitioners' application for grant of permission for establishing Technical Institution as aforesaid.

Now, when the matter is taken up for consideration neither the learned Counsel for the petitioners nor the learned Standing Counsel for the respondents is in a position to inform this Court with regard to the result of the interim order granted by this Court on 08.04.2009. However, learned Standing Counsel for AICTE submits that new Regulations have come into force with effect from 10.12.2010 and in that view of the matter, if the application of the petitioners was rejected consequent to the interim direction dated 08.04.2009, it is open to the petitioners to apply afresh in accordance with the new Regulations. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
