THE HON'BLE SRI JUSTICE S. V. BHATT WRIT PETITION No.10660 OF 2015 ORDER:

The petitioner prays for Mandamus declaring the action of the 2nd respondent in refusing to register the property in an extent of 150 sq. yards in Sy.No.913/1A of Chintalapudi Village and Mandal on the ground that the land is 'Gramakantam', as illegal, arbitrary and unconstitutional.

Learned counsel for the petitioner has drawn the attention of the Court to the certificate of market value of the subject land issued by the Sub-Registrar/the 2nd respondent on 27.03.2015. The certificate inter alia refers to the valuation of the property covered by D.No.8-212 and shows that R.S.No.913/1A of Chintalapudi Village is classified as 'Gramakantam' and is included in the prohibitory list.

This Court vide order dated 02.04.2015 in W.P.No.9093 of 2015 considered in detail the power of the Revenue Department to include 'Gramakantam' land in prohibitory list for the purpose of Section 22-A of the Registration Act, 1908 and held that automatically the Gramakantam land does not vest in the Government.

The Writ Petition is accordingly ordered in terms of the order dated 02.04.2015 in W.P.No.9093 of 2015. No order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
