HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18356 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondent police in illegally calling the petitioner to the police station without there being any case or crime and threatening to come to the police station, as illegal, arbitrary, discriminatory and violation of Article 14 and 21 of the Constitution of India, and consequently to direct the respondents herein not to call the petitioner to the police station without due process of law.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home on instructions submits that the wife of the petitioner gave complaint on 20.05.2018 requesting to initiate action against her husband and to give counseling; that in pursuance of the said complaint an entry was made into the Station General Diary on 20.05.2018; and that thereafter the wife of the petitioner requested the Station House Officer not to initiate any action on her complaint as she telephoned her husband vwho promised to attend the police station on 22.05.2018 for counseling. It is further stated that as of now, neither the complainant-petitioner's wife nor the petitioner approached the police station in respect of their case; that no case was registered against the petitioner on the complaint of his wife

and that the respondent police did not summon the petitioner or harass him as alleged. It is also stated that in matrimonial cases it is mandatory on the part of the respondent police to counsel the parties before initiating any action. Since in the written instructions it is stated that the respondents require the petitioner only for the purpose of counseling, the writ petition is disposed of recording the aforesaid written instructions made by the respondents. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 05.06.2018 t k.
