Gopal Yadav, v. The Superintending Engineer (Operations)
THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.5975 of 2005 ORDER:
The petitioner complains against inaction of respondents in sanctioning electricity service connection to premises bearing No.3-2-734/1 at Chappal Bazar, Hyderabad, as illegal, arbitrary and unconstitutional.
On 23-03-2005, this Court directed the respondents to provide temporary connection to petitioner.
Learned counsel appearing for petitioner submits that temporary connection is given.
Learned standing counsel appearing for respondents seeks further time to file counter affidavit.
The writ petition was admitted on 23-03-2005. The request for grant of time to file counter affidavit is not correct and therefore rejected.
Having regard to the facts of this case, I am satisfied that the writ petition can be disposed of by this order. The interim order granted on 23-03-2005 is made final order in the writ petition. The petitioner in accordance with the Regulations is required to get regular connection sanctioned in his name.
Therefore, the petitioner is given eight weeks time from the date of receipt of a copy of this order, to apply for regular connection and the respondents are directed to pass appropriate orders within eight
weeks thereafter. The petitioner is under obligation to pay amount towards consumption and other incidental charges as are applicable.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
