THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.263 of 2017 ORDER:

Heard Sri Chandra Sekhar Ilapkurti, learned counsel for the petitioners and learned Additional Public Prosecutor for the State of Telangana.

The present petition is filed to invoke the jurisdiction under Section 482 Cr.P.C.

Learned counsel for the petitioners pleads innocence and false implication of the petitioners submitting that on the complaint of the 1st petitioner in the concerned police station, police have registered a case in Crime No.104 of 2014 for the offences punishable under Sections 324 and 506 read with 34 IPC, though, it was registered prior to registration of present crime i.e., Crime No.105 of 2014. It is also his submission that the police in fact, ought to have conducted investigation and must have filed charge sheet on the same day. 4.

Learned counsel for the petitioners also raised certain submissions, but those submissions cannot be adjudicated at this stage. Suffice to say that detailed overt acts of A.1 and A.2 have been mentioned not only in the charge sheet but also supported by the statements of witnesses filed by the learned counsel for the petitioners.

In that view, certainly it cannot be said that there is no prima facie material at all showing the complicity of the petitioners herein. It is not a case where extraordinary jurisdiction can be invoked as it does not satisfy either abuse of process of Court in prosecuting the present case or a case where there is no prima facie material at all. 6.

Hence, the Criminal Petition is dismissed at the stage of admission. Miscellaneous petitions, if any, pending in this petition shall stand closed.
