HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.17318 of 2012 Order:

The petitioner states that he is the sole proprietor of M/s Sardar Garments. Admittedly, the fifth respondent is the owner of the property and the petitioner is the lessee. He has taken one of the three mulgies in the premises owned by the fifth respondent and he is doing wholesale garments business in the name and style of M/s Sardar Garments in the premises bearing Door No.2-7-60, Sikhwadi, Opp. KDCC Bank Limited, Karimnagar. When there was an apprehension with regard to his forcible eviction, the petitioner filed O.S.No.310 of 2006 seeking perpetual injunction and the said suit was decreed on 31.12.2012. This Writ Petition was filed seeking a direction to the respondents 2 to 5 not to evict the petitioner from the same premises.

Learned counsel appearing for the fourth respondent submits that the fourth respondent never forced the petitioner to vacate the premises or took any action for demolition of any part of the building and whenever any action is needed they would follow due process of law. Learned counsel for the fifth respondent submits that seeking eviction of the petitioner they filed O.S.No.523 of 2010 on the file of the Principal Junior Civil Judge, Karimnagar and the said suit is pending. In view of the pendency of the civil suit and in view of the decree obtained by the petitioner in O.S.No.310 of 2006 dated 31.12.2012, no further orders are required in the present Writ Petition and, accordingly, the Writ Petition is closed recording the statements of the counsel

ARLR, J WP No.17318 of 2012 appearing for the respondents 4 and 5. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
