Chowdavaram Chinnaiah v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.18351 of 2018 O R D E R:
Petitioner's fair price shop dealership license was suspended pending enquiry pursuant to the impugned order dt.18.04.2018 on the allegation that in the stock in petitioner's premises was found to be beyond permissible limits, particularly sugar stocks. Petitioner has submitted explanation thereto.
2.
Though counsel for petitioner contends that suspension pending enquiry is not warranted since there is no prima facie material to suspend the authorization of the petitioner, in view of the alleged excess stock of sugar found beyond permissible variation, I am not inclined to interfere with the impugned order. However, since the explanation of the petitioner has already been submitted to the show cause notice dt.21.03.2018 issued by the 3rd respondent, the 3rd respondent is directed to complete the enquiry into the allegations leveled against the petitioner and complete the same within a period of two (02) months from the date of receipt of a copy of this order, after complying with the principles of natural justice.
3.
The Writ Petition is disposed of with the above directions. No order as to costs.
4.
Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
