Burukunta Gopal v. State Of Telangana And 2 Others
HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.21225 of 2019 ORDER:
It is stated by learned counsel petitioner as well as learned Government Pleader for Revenue appearing for respondents that the issue in this Writ Petition is covered by the order dt.06-06-2019 in W.P.No.10832 of 2019.
2.
Therefore, for the reasons alike, this Writ Petition is also disposed of directing the 3rd respondent to receive and process the documents presented by petitioner without reference to the Notification dt.26-09-2013 issued by the District Collector, Ranga Reddy District. In the event the said documents are found to be fit for registration, the 3rd respondent shall complete the due formalities in accordance with law and release the documents. However, if he still finds any ground to exercise power under Section 71 of the Act of 1908 and refuse registration, he shall pass a reasoned order and communicate the same to the petitioner. This exercise shall be completed expeditiously and in any event, not later than one month from the date of receipt of a copy of this order, be it from whatever source.
It is also made clear that mere registration of the documents would not confer title upon the property covered thereby, if it is otherwise wanting, and would not preclude the Government from taking appropriate steps as warranted by law, if it seeks to assert any right or title over the said land. No costs.
MSR,J W.P.No.21225 of 2019 3.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
