HON'BLE Dr. JUSTICE SHAMEEM AKTHER SECOND APPEAL No.580 OF 2018 JUDGMENT:

This appeal is filed by the appellant - defendant aggrieved by the judgment and decree, dated 20.03.2018, rendered in A.S.No.5 of 2018 on the file of XII Additional Chief Judge, City Civil Court, Secunderabad.

2. Heard both sides. Perused the record.

3. Learned counsel for the appellant produced a photostat copy of the affidavit filed by the appellant before this Court today stating that the parties have compromised the subject matter of the appeal outside the Court.

4. As per the terms of compromise, the appellant agreed to vacate the suit schedule premises by 31.03.2019 and hand over vacant possession of the same to the respondent herein. It is also agreed by both the parties that the respondent - landlord would not claim mesne profits.

5. In view of the compromise entered into between the parties, nothing survives for adjudication in this appeal. As such, the Second Appeal is dismissed as withdrawn.
