THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.18507 of 2018 ORDER:

Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC.

The alleged inaction on the part of the respondent Nos.2 and 3, in taking action on the representation, dated 17.05.2018, said to have been made by the petitioner herein, with regard to the constructions in the land admeasuring Ac.14.37 gunts in Sy.No.70 situated at Sahebnagar Kalan village, Hayathnagar mandal, Ranga Reddy District, is under challenge in the present Writ Petition.

The information available before this Court discloses that the revenue authorities granted ORC in favour of the unofficial respondents herein and, aggrieved by the same, petitioner herein filed an appeal before the Joint Collector, Ranga Reddy District, under Section 24 of the Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955, and the same was rejected. Questioning the said order, petitioner herein carried the matter, by way of appeal, before the Chief Commissioner and the same is pending consideration. It is also clear from the record that the petitioner herein also instituted O.S.No.1565 of 2016, on the file of the Court of the Principal Senior Civil Judge, L.B.Nagar, Ranga Reddy District, seeking permanent injunction in respect of the subject property against the respondents and the said suit is also

pending consideration. Now, by way of a representation, dated 17.05.2018, petitioner herein is seeking the respondent Corporation not to grant any permission and not to allow any third party to make any construction in the subject land pending appeal before the Chief Commissioner. Having chosen a different fora, for redressal of his grievance, and pursuing the said remedies, in the considered opinion of this Court, it is not open for the petitioner herein to maintain the present Writ Petition before this Court. For the aforesaid reasons, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
