THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.6589 of 2009 ORDER :

This Writ Petition was listed for hearing on 28-072014. As there was no representation for the petitioner on that day, the Writ Petition was directed to be posted to 01-082014 under the caption 'for dismissal'. On 01-08-2014 also as there was no representation for the petitioner, the matter was directed to be posted to 04-08-2014. On 04-08-2014, at the request of the counsel for the petitioner, the matter was directed to be posted to 07-082014. At the request of the learned Government Pleader, on 07-08-2014 and 21-08-2014, the matter was adjourned, but the matter stands under the caption 'for dismissal'. Likewise, there was no representation for the petitioner even though the matter has been coming up under the caption 'for dismissal' on 04-02-2015, 11-022015, 18-02-2015, 25-02-2015 and also even today.

2. On the earlier occasion, since the counsel for the petitioner was not present in the Court, this Court passed an order dismissing the Writ Petition for non-prosecution. However, subsequent to passing of the order, the learned counsel for the petitioner appeared before the Court and represented that he was not able to reach the Court in

time, hence the said order was not recorded and again the matter was directed to be posted to 09-03-2015 i.e., today, under the same caption - 'for dismissal'. Even today, in spite of the matter being listed under the caption 'for dismissal', again there is no representation for the petitioner. From the continuous absence of the counsel for the petitioner, it appears that the petitioner is not interested in prosecuting the matter.

3. Hence, the Writ Petition is dismissed for nonprosecution. No order as to costs.

4. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed.
