UMA DEVI I.A.NO. 1 OF 2018 AND C.M.A.No.317 of 2006 JUDGMENT: (per Hon'ble Sri Justice C.Praveen Kumar) 1) The appeal is filed against the judgment and decree dated 08.12.2005 passed in O.P.No.23 of 2002 on the file of the Senior Civil Judge, Tadepalligudem.

2) The respondent herein filed O.P.No.23 of 2002 seeking divorce on the ground of cruelty and desertion. Vide judgment and decree dated 08.12.2005, the learned Senior Civil Judge, Tadepalligudem, allowed the said O.P. Challenging the same the present appeal is filed by the appellant/ wife.

3) During pendency of the appeal, the appellant filed I.A.No.1 of 2018, along with a compromise memo. Today the appellant and respondent are present and they were identified by their counsel. Sri N.Bharath Babu, Advocate, identified the appellant-wife and Sri S. Subba Reddy, Advocate, identified the respondent-husband. In the compromise memo, it has been stated that the appellant agreed to pay Rs.9,75,000/ - to the appellant towards permanent alimony. When examined, the appellant stated that she has received demand drafts bearing Nos. 656048 for Rs.9,50,000/ - and D.D.No.656047 for Rs.25,000/ -, dated 26.02.2018, drawn on State

Bank of India, Tadepalligudem, towards her full satisfaction. She also agrees that she will not claim any right over the retirement benefits of the respondent and that both of them will lead their own individual lives, hereinafter.

4) In view of the above and having regard to the settlement arrived at between the parties, we deem it appropriate to dispose of the appeal in terms of the compromise.

5) Accordingly, C.M.A. No.317 of 2006 is allowed in terms of the compromise. Consequently, the order dated 08.12.2005 passed in O.P.No.23 of 2002 on the file of the Senior Civil Jude, Tadepalligudem, is hereby confirmed. The terms of compromise shall form part of this order. Miscellaneous petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
