THE HONOURABLE SMT. JUSTICE P. MADHAVI DEVI WRIT PETITION NO.29588 OF 2022

O R D E R

In this Writ Petition, the petitioners are seeking a Writ of Mandamus declaring the proceedings Lr.No.5/2021-23/Rabi dt.22.06.2022 of the 4th respondent in disconnecting the electricity supply to the petitioners in respect of their business concerns as illegal and arbitrary and to set aside the same and consequently to direct the respondents to restore the electrical supply to them and to pass such other order or orders as this Court may deem fit and proper in the circumstances of the charges.

2.

This Court vide orders dt.18.07.2022 had directed restoration of power supply to the petitioners/rice mills subject to the petitioners clearing all the consumption dues.

3.

Learned counsel for the petitioners, Sri A. Jagan, submitted that the petitioners have complied with the said condition and the power supply has been restored to the petitioners' concern. He submitted that no further orders are necessary in this matter.

W.P.No.29588 of 2022 4.

Learned Standing Counsel, Sri Zakir Ali Danish, appearing for respondents 2 and 4, however, submitted that all the three writ petitioners have not paid the consumption charges. 5.

The learned counsel for the petitioners submitted that consequent to the letter of the District Collector, Warangal dt.22.06.2022, the respondents have disconnected the power supply. 6.

The learned Standing Counsel, however, refuted this contention and submitted that power supply was disconnected due to non-payment of pending arrears of consumption charges.

7.

Since the learned counsel for the petitioners submitted that all the consumption charges have been paid and the petitioners will continue to make payment of the consumption charges, this Court deems it fit and proper to dispose of this Writ Petition with a direction to the respondents to continue the power supply to the petitioners' concerns subject to the petitioners making payment of all dues of consumption charges and also current consumption charges. 8.

The Writ Petition is accordingly disposed of. No order as to costs.

W.P.No.29588 of 2022 9.

Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed.
