THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24249 of 2009 ORDER:

This writ petition was filed challenging the action of respondents 1 to 3 in not taking any action against fourth respondent for undertaking unauthorized construction in Sy.No.1091, Kavali, SPSR Nellore District in spite of the representation submitted by the petitioner on 03.09.2009.

2. In view of non-filing of counter by the second respondent - Municipality, an interim direction was granted on 25.11.2009, but it was modified on 20.04.2011 giving liberty to the fourth respondent to proceed with the balance construction work subject to his obtaining permission from the competent authority. In view of the said modified order dated 20.04.2011, no further orders are necessary in the present writ petition.

3. Hence, the writ petition is closed. However, if the petitioner has any grievance against the fourth respondent, he can proceed against him in accordance with law. No order as to costs. Miscellaneous petitions, if any pending, shall stand closed.
