CRIMINAL PETITION NO. 6501 OF 2011 O R D E R :
The petitioner is A-2 in CC.No. 107 of 2009 on the file of the Court of Judicial Magistrate of First Class, Piler, Chittoor district, registered for the offence punishable under section 309, 447 and 427 of IPC.
2. Accused No.1 is the de facto complainant. The case of the prosecution is that accused No.2 ploughed in the lands of accused No.1 causing damage to the tomb of father of accused No.1 and also interfered regularly with his lands. Accused No.1 could not bear the harassment of accused No.2 and consumed poison on 20/09/2007 at about 08:30a.m., but he survived with immediate medical-aid provided by his brother. Investigation has been completed and charge sheet has been filed.
3. Heard both sides and perused the material available on record.
4. The investigation does not disclose cogent reasons for attracting the offence under sections 307 and 427 of IPC. It is not stated
in the investigation about the attempts made by accused No.2 in interfering with the land of accused NO.1. Due to lack of cogent reasons, the case has not been made out against accused No.2.
5. For the reasons stated above, this Criminal Petition is allowed and C.C.No. 107 of 2009 on the file of the Court of Judicial Magistrate of First Class, Piler, Chittoor district, is quashed in-so-far as petitioner/accused No.2 is concerned.
6. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
