THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.25611 of 2009 ORDER:
The petitioner prays for the following relief: ".......to issue a Writ, Order or Direction more particularly one in the nature of WRIT of MANDAMUS by declaring the impugned Order vide Rc.No.8440/2008/G5, dated 23-06-2009 issued by the 1st Respondent in respect of my property to an extent of Ac.4.38 Cts situated at D. Hirehal Village and Mandal, Ananthapur District, as illegal, arbitrary, without application of mind, contrary to the provisions of the Land Acquisition Act and in violation of the principles of natural justice and under Article 14 & 19 of the Constitution of India and consequently set aside the same and to pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

The petitioner primarily obtained status quo order and thus prevented to proceed with the acquisition. The respondents are given liberty to continue from the stage of overruling the objection through proceedings, dated 23.06.2009, under Part IV of Act 30 of 2013 and it is needless to observe that finally if the land is required for acquisition, compensation is paid under Act 30 of 2013. 3.
With the above observations, the writ petition is dismissed. 4.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
