Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies (A.P.).

This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner vide proceedings dated 11.03.2015, as arbitrary and illegal.

Petitioner is the Dealer of Fair Price Shop No.13, Kailasapuram of Puttur Mandal, Chittoor District. Based on the report submitted by the Tahsildar alleging certain irregularities and variations in the stock at the time of inspection, the 3rd respondent suspended the authorization of the petitioner straight away, without issuing any notice and without conducting any enquiry. Since the impugned order was passed pending enquiry, the Writ Petition is disposed of directing the 3rd respondent-Revenue Divisional Officer, to conduct enquiry and pass final order within a period of eight (8) weeks from the date of receipt of a copy of this order, failing which, the authorization of the petitioner shall stand restored. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ JUSTICE R.KANTHA RAO 30th April, 2015 GJ
