THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7612 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.3 and 5 seeking bail in the event of their arrest in connection with Crime No.294 of 2023 dated 19.03.2023 on the file of Police Station, Medipally, Rachakonda registered for the offences punishable under Sections 148, 307, 342, 506, 384, 109 read with 149 of Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

This Court by order dated 07-06-2023 granted the relief of anticipatory bail to Accused Nos.6, 8 and 9. The petitioners stand on the same footing. It is not disputed by the learned public prosecutor. On the ground of parity, these petitioners can be granted similar relief.

This Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-

1) The petitioners/Accused Nos. 3 and 5 are directed to surrender before the Station House Officer, Medipally, Rachakonda on 23.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos. 3 and 5 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to his satisfaction.

2) The petitioners/Accused Nos. 3 and 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
