HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.180 of 2017 ORDER :

Heard learned counsel for the petitioner and learned Public Prosecutor representing the State/ respondent No.4 before ordering notice to respondents 1 to 3, no other than wife and children and petitioners in M.C.No.22 of 2016 on the file of the Judicial First Class Magistrate, Guntakal, which is seeking to transfer to any other Court in Kurnool District, on the allegation that there is a threat to the life of the petitioner in the hands of wife and her family members. There is no basis for believing of such a threat to the life of the petitioner and even otherwise, by virtue of this order, if there is any threat he can take the assistance of Police, on payment of usual charges to the Deputy Superintendent of Police concerned, Adoni area.

Accordingly, the Transfer Criminal Petition is disposed of. The Deputy Superintendent of Police concerned, Adoni area, shall provide the Police assistance, on the application of the petitioner, by collecting necessary charges to attend the Court. The petitioner is at liberty to file special vakalat application under Section 126(2) Cr.P.C. to represent through advocate, but for, on any necessary days of his personal appearance.
