Heard learned Government Pleader for Revenue for respondent Nos.1 to 3.
The petitioners, in the instant writ petition, made similar prayer as made in W.P.Nos.24381 of 2009, 36250 & 33643 of 2014, 4869, 5028 and 1909 of 2015. All these writ petitions, we have disposed of today in view of the order passed in PIL No.517 of 2013. The order passed in PIL No.517 of 2013 reads thus: "The statements, made by learned Advocate Generals for both the States that they shall not implement or act upon G.O.Ms.No.166, dated 16.02.2008, are accepted. It is open to the petitioners to make representation for removal of encroachments that were regularised or ordered to be regularised on the basis of G.O.Ms.No.166, dated 16.02.2008, within 8 weeks from today.
If any such representation is made, we hope and trust that the concerned authority shall deal with the same in accordance with law observing the principles of natural justice." In view thereof, the prayer made in the writ petition, in our
opinion, has rendered infructuous.
Writ petition is accordingly disposed of as infructuous. This, however, shall not preclude the petitioners from approaching the State Government for appropriate relief. If the petitioners make any such representation within a period of four weeks from today, we hope and trust that the concerned authority of the Government shall consider the same strictly in accordance with law.
