HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.37296 OF 2016 ORDER:

Heard the learned counsel for the petitioner and perused the Writ Petition prayer and also the supporting affidavit and the other material vis-à-vis the counter with vacate petition filed by the 5th respondent and the written instructions on behalf of the respondent Nos. 1 to 4 submitted by the learned Govt. Pleader for Land Acquisition.

As per the learned Govt.Pleader from the written instructions, there is an award already passed however compensation could not be disbursed or awarded pursuant to the award because of the interim order of this Court in this Writ Petition dated 01.11.2016.

Undisputedly, the interim order granted for 8weeks from that date (dt.01.11.2016) and there is no further extension. Thereby that is not in the way to the Land Acquisition Officer to disburse the compensation. If any of the petitioner or 5th respondent aggrieved by the award, their remedies are left open and they can approach the Land Acquisition Officer pursuant to this order, to secure the copy of the award and if at all for apportionment of the amount by the Land Acquisition Officer either by consent or on merits or if at all aggrieved to work out for further rights.

Accordingly, the Writ Petition is disposed of. As a sequel, miscellaneous petitions if any pending in this Writ Petition shall stand closed.
