THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39736 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents 2 to 4 in not acting on the petitioner's representations, dated 11.09.2015 and 08.09.2015, as illegal and arbitrary and consequently, direct the respondents 2 to 4 to give protection to the life and liberty of the petitioner by registering FIR against the respondents 6 and 7.

Heard and perused the material available on record. The main grievance of the petitioner is that he made representations to the Station House Officer, Ravikamatham Police Station, Visakhapatnam and also to the Superintendent of Police, Visakhapatnam Rural, on 08.09.2015 and 11.09.2015, respectively, to take action against the respondents 5 and 6 since they are interfering with the peaceful possession and enjoyment of his property and also threatening him with dire consequences. But, the respondents 3 & 4 have not taken any action so far, on the representations made by the petitioner.

Considering the grievance of the petitioner, the respondents 3 & 4 are directed to register a case against the respondents 6 and 7, if the complaints lodged by the petitioner, dated 11.09.2015 and 08.09.2015, disclose any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the respondents 3 and 4, he is at liberty to approach the superior officer the respondents 3 and 4 and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C. Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 17, 2016.
