THE HON'BLE SRI JUSTICE P.NAVEEN RAO Writ Petition No.34818 of 2012 ORDER :

The petitioner was working as Driver in the Respondent-Corporation. By order dated 29.4.2009, the petitioner was removed from service. Challenging the said removal/termination, petitioner raised Industrial Dispute in I.D.No.103 of 2009 in the Additional Industrial Tribunal-cumAdditional Labour Court, Hyderabad. By the order impugned, the claim of the petitioner was rejected holding as "Nil Award" on the ground that petitioner did not show interest in prosecuting the case. Having regard to the fact that the Nil Award was passed without adjudicating the matter on merits, learned counsel for the petitioner as well as the learned Standing Counsel representing the Respondent-Corporation have agreed for remanding the matter for adjudication on merits of the claim made by the petitioner.

Accordingly, the Writ Petition is allowed and the Award, dated 26.9.2012 made in I.D.No.103 of 2009 is set aside and the matter is remanded to the Labour Court for consideration of I.D.No.103 of 2009 on merits. Having regard to the fact that I.D. is of the year 2009, the Labour Court shall expedite the hearing of the I.D. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
