Heard the learned counsel for the petitioner, the learned Government Pleader for Civil Supplies appearing for respondent Nos.1, 3, 4, 6 and 7, Sri T.P. Acharya, learned Standing counsel for respondent No.2, the learned Standing counsel for respondent Nos.5 and 8 and the learned Standing counsel for respondent No.9. With their consent, the present Writ Petition is being disposed of at the stage of admission. 2.

Seeking to declare the action of respondent No.4 in issuing impugned proceedings dated 24.09.2021 directing respondent Nos.5 and 8 to take immediate steps to freeze his bank account as illegal and arbitrary, the petitioner has filed the present writ petition.

Learned counsel for the petitioner contends that the impugned proceedings have been issued by respondent No.4 without putting the petitioner on notice or without giving him an opportunity of hearing, which is in violation of the principles of natural justice.

Without going into the merits or demerits of the case, having regard to the fact that no notice was served on the petitioner, the writ petition is allowed and the impugned proceedings dated 24.09.2021 to the extent of freezing the bank account of the petitioner is set aside and remanded back to the authority concerned for passing reasoned orders afresh duly putting the petitioner on notice and giving him an opportunity of hearing.

Miscellaneous petitions, if any, pending, shall stand closed.
